These Terms of Service ("Terms") govern your access to and use of Total Recall ("Service"), operated by Cleo 3 LLC, a Colorado limited liability company. By accessing or using the Service, you agree to be bound by these Terms.
Total Recall provides persistent, encrypted, on-chain memory storage for AI agents and individuals, including key-value memory, file storage, secret vault, API access, and shared memory spaces — all running on the Internet Computer blockchain.
You must be at least 18 years old to use the Service. You are responsible for maintaining the security of your Internet Identity and API keys. We are not liable for any loss resulting from unauthorized account access. You are responsible for all activity under your account.

All payments are processed via Stripe. Prices are in USD and are final and non-refundable. We reserve the right to change pricing with 30 days' notice.
Card subscriptions renew automatically each month via Stripe. We reserve the right to change pricing with 30 days' notice via email or dashboard notification.
Cancellation by you: Cancel anytime via Settings or by emailing support@totalrecallagent.com. Your account reverts to Free tier at the end of the paid period. No partial refunds for unused days.
After cancellation: Your data is preserved but subject to Free tier limits (100 MB). If you exceed the limit, you have 30 days to export or delete data before it may be trimmed.
Subscription pause: You may pause your paid subscription at any time through the Settings tab. Upon pausing, you retain full access to your paid tier features through the end of your current billing period. No charges are made for subsequent billing periods while paused. To resume, reactivate your subscription in Settings — your next billing date is set from the date of resumption. Paused accounts are subject to the same data retention policies as canceled accounts.
Failed payment / on hold: If a card payment fails, we retry up to 3 times over 7 days. On continued failure, your account enters a 30-day hold at Free tier limits. Data is preserved during the hold. After 30 days, data exceeding Free limits may be removed. You'll be notified by email at each step.
Termination by us: We may suspend or terminate accounts that violate these Terms. Terminations without cause include a prorated refund for card subscribers.
No refunds. All payments — whether by ICP or credit/debit card — are final and non-refundable. We do not issue refunds for any reason, including unused days, plan downgrades, or early cancellations.
Try before you buy. We offer a Free tier so you can fully evaluate the Service before upgrading. Upgrading to a paid plan constitutes your acceptance that the payment is non-refundable.
Avoiding unwanted charges: Cancel or pause your subscription before your renewal date to avoid being charged for the next billing period. You retain access through the end of the period already paid for.
You agree not to use the Service to store or transmit illegal content, violate applicable laws, gain unauthorized access, reverse engineer the Service, impair the Service's operation, resell without permission, or infringe on third-party rights.
You retain full ownership of all data you store. We do not claim intellectual property rights over your content. Secrets are encrypted client-side — we cannot access your decryption keys. You may export your data at any time. See our Privacy Policy at totalrecallagent.com/privacy.
The Service, including its design, code, and branding, is owned by Cleo 3 LLC. You receive a limited, non-exclusive, non-transferable license to use the Service as provided.
THE SERVICE IS PROVIDED "AS IS" WITHOUT WARRANTIES OF ANY KIND. We do not warrant uninterrupted or error-free operation. We are not liable for disruptions caused by the Internet Computer network or other factors outside our control.
TO THE MAXIMUM EXTENT PERMITTED BY LAW, CLEO 3 LLC SHALL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES. OUR TOTAL LIABILITY SHALL NOT EXCEED THE AMOUNT YOU PAID IN THE 12 MONTHS PRECEDING THE CLAIM.
You agree to indemnify and hold harmless Cleo 3 LLC from claims, damages, or expenses arising from your use of the Service or violation of these Terms.
These Terms are governed by Colorado law. Disputes shall be resolved in state or federal courts in Denver, Colorado. Before legal action, contact legal@totalrecallagent.com and allow 30 days for informal resolution.
We may modify these Terms with at least 14 days' notice via email or dashboard notification. Continued use after the effective date constitutes acceptance.
